• WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

• WARRANTIES THAT DEFECTS WILL BE CORRECTED

IN ANY CASE, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE THIRTY (30) DAYS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

These limitations apply even if Pizza Luce has been advised of the possibility of such damages. Some states do not allow the limitation of liability for certain types of damages, so some limitations may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless Pizza Luce, and its respective officers, directors, members, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including, without limitation, reasonable attorneys' fees and court costs) arising from or relating to:

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

We will attempt to resolve the dispute informally within thirty (30) days of receipt of your notice. If the dispute is not resolved within that timeframe, either party may proceed to arbitration as set forth below.

13.2 Binding Arbitration

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, YOU AND PIZZA LUCE AGREE THAT ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR YOUR USE OF THE SITE OR SERVICES, SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION.

The arbitration shall be conducted by a nationally recognized arbitration organization, such as the American Arbitration Association (AAA), under its then-current Consumer Arbitration Rules. The arbitration shall be conducted in English and, unless otherwise agreed, shall take place in the United States. YOU AND PIZZA LUCE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.

13.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim qualifies and remains in small claims court, is not removed or appealed to a court of general jurisdiction, and seeks only individual relief.

14. Term and Termination

The failure of Pizza Luce to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver by Pizza Luce of any default or breach shall not constitute a waiver of any subsequent default or breach.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or agreements incorporated by reference herein, constitute the entire agreement between you and Pizza Luce with respect to the subject matter hereof and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.
